These Terms of Use (“Terms”) constitute a legally binding agreement between you, whether personally or on behalf of an entity you represent (“you” or “User”), and Shurr Insurance Agency, LLC (“Shurr,” “we,” “us,” or “our”), concerning your access to and use of our website and any related pages or content (collectively, the “Site”). By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms. Fraudulent misrepresentation in connection with an insurance application or claim may constitute a criminal offense under Indiana law (IC 35-43-5-4) and may be reported to appropriate authorities.

Governing Law

To the extent any federal law applies, those laws shall govern in the event of any conflict with state law. You consent to exclusive jurisdiction and venue in the state and federal courts located in Porter County, Indiana for any action or proceeding not subject to arbitration.

Dispute Resolution

Except as set forth below, any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site shall be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) in Valparaiso, Indiana, or by remote means if mutually agreed. The arbitrator’s award shall be final and may be entered as a judgment in any court of competent jurisdiction.

BY AGREEING TO THESE TERMS, YOU WAIVE ANY RIGHT TO A JURY TRIAL WITH RESPECT TO ANY DISPUTE ARISING UNDER OR RELATED TO THESE TERMS OR THE SITE. All disputes shall be resolved on an individual basis; you agree that you will not bring or participate in any class action, collective action, or representative proceeding against us.
